Wuestling & James wrote and argued a winning Motion for Summary Judgment in St. Louis County Circuit Court, successfully arguing in a construction defect case that the plaintiff had failed to file its Petition within the time period allotted under the relevant statute of limitations. W&J’s position was that the statute of limitations began to run when the plaintiff was first made aware of the alleged harm, regardless of the increasing nature of the damage to plaintiff’s property from the harm. The Court agreed and dismissed the Petition. The case is currently before the Missouri Circuit Court of Appeals on review.
